Terms and conditions of use
These conditions are valid exclusively between the company Zoffoli Mappamondi S.r.l. and anyone who purchases products online on the website www.zoffoli.com hereinafter referred to as '' CUSTOMER ''. These conditions may be subject to modifications and, the date of publication of the same on the site, is equivalent to the date of entry into force.
These conditions govern purchases made on the www.zoffoli.com site, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree n. 206/2005, amended by Legislative Decree n. 21/2014 and by Legislative Decree 70/2003 concerning electronic commerce.
1. Company Data
The products purchased on Zoffoli are sold directly by the company Zoffoli Mappamondi S.r.l. duly registered in the register of companies of Rimini RN 325648 with VAT number 04103830404 Zoffoli Mappamondi S.r.l has its registered office in via Santo Marino 250 47824 Poggio Berni (Rn). Zoffoli Mappamondi S.r.l owns the website www.zoffoli.com
2. SUBJECT OF THE CONTRACT
With these general conditions of sale, Zoffoli sells and the CUSTOMER remotely purchases the movable tangible assets indicated and offered for sale on the site www.zoffoli.com. The contract is concluded through the internet, through the CUSTOMER access to www.zoffoli.com and the realization of a purchase order according to the procedure foreseen by the site itself. The CUSTOMER before the conclusion of the purchase contract, examines the characteristics of the goods that are illustrated in the individual product data sheets at the time of the CUSTOMER's choice.
3. ACCEPTANCE OF SALES CONDITIONS AND GENERAL TERMS
The contract stipulated between Zoffoli and the Customer must be considered concluded with the dispatch by Zoffoli of an e-mail confirming the order of the customer. The e-mail contains the data of the CUSTOMER and the order number, the price of the goods purchased, the shipping costs and the delivery address to which the goods will be sent. The CUSTOMER undertakes to verify the correctness of the personal data contained in the aforementioned email and to promptly notify Zoffoli of any corrections / changes to be made. By placing an online, telephone or e-mail order, the Customer declares to have read and fully accepted the general conditions of sale and payment transcribed below. The Customer must keep these general conditions of sale (in compliance with the provisions of articles 50 and ss of Legislative Decree 206/05) by printing a copy or saving it electronically.
4. PURCHASE PROCEDURE
The Customer can buy the products sold in the electronic catalogue found on the website www.zoffoli.com, as described in the relative informational data sheets or in communications via email, also following contacts with Zoffoli's sales staff. The receipt of the order is confirmed by Zoffoli by e-mail sent to the e-mail address communicated by the Customer. This confirmation message will contain all the information regarding the order.
Once the order has been received by the Customer, Zoffoli will verify the payment and then start the phases related to the production / shipment of the goods.
Any notice of non-acceptance of the order due to unavailability of the product and / or longer delivery times than those indicated in the product sheet, will be promptly communicated to the customer, by phone or by e-mail.
In such cases, the Customer may alternatively change the product, wait for availability in the new times communicated or cancel the order requesting reimbursement for any sum already paid. Any right of the Customer to compensation for damages is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to people and / or things, caused by the non-acceptance, even partial, of an order.
Any changes to orders already submitted may be made by the customer within 3 days from the date of execution of the same and must be sent in writing to Zoffoli by e-mail. Any changes to orders sent after this deadline (3 days) cannot be guaranteed and will be authorized by Zoffoli on the basis of the progress of production.
5. PRODUCTS AVAILABILITY
Product availability must be considered purely indicative as:
-Due te the completely handcrafted nature of our product, it may take more than 60 days for the production.
- The products could be sold to other CUSTOMERS before confirming the order, due to the simultaneous presence on the site of several users,
- an information anomaly could occur that would make a product available for purchase that in reality is not. Even after sending the order confirmation email sent by Zoffoli, there may be cases of partial or total unavailability of the goods. In this case, the order will be automatically adjusted with the elimination of the unavailable product or products and the CUSTOMER will be immediately informed by e-mail; with this e-mail the customer will also be informed of the methods and timing of repayment of any amounts paid.
6. Terms of Delivery
If the products is available in our warehouse, Zoffoli requires up to three business days for the procurement of goods, packaging and the completion of the necessary administrative procedures.
In case of payment by bank transfer it is advisable to consider a further 24/48 hours, necessary for the bank to credit the transfer.
Given the highly artisanal nature of our products, however, some products may not be available for shipment. In this case, the globe is put into production upon receipt of the order, and we will promptly notify the customer of the alleged timeframes of evasion.
Some products may take 60 to 90 days to produce.
In addition to these days, you must also calculate the time taken by the courier for delivery. This calculation does not take into account Saturdays, Sundays and public holidays.
Average delivery times are as follows:
Shipping within Italy 1/2 working days from the shipping confirmation.
Shipping within Europe 2/5 working days from the shipping confirmation.
Extra Europe Shipping 7/20 working days from the shipping confirmation.
If the customer is not able to be present at the place of delivery at the agreed time, we ask that you contact us again to agree on a new delivery date.
If the delivery cannot take place for reasons not attributable to us after 30 days from the date on which the order is available for delivery, we will assume that it is intended to terminate the contract.
The shipping costs are charged to the customer and are calculated based on the volume of the goods and the place of destination of the goods. The delivery that is made by the carrier is standard and therefore to the street level and, for particularly heavy or bulky packages, the customer must collaborate with the carrier for the unloading of the goods. It is possible to deliver to the floor after notifying customer service. This service may include additional costs. No responsibility can be charged to Zoffoli due to delivery delays attributable to the transporter in charge. The products are packed with resistant materials and suitable for ensuring optimal protection during transport, also in relation to the choice of the type of conveyor to be used.
7. Prices and Terms of payment
All prices shown and indicated on the website are expressed in euros and constitute an offer to the public pursuant to article 1336 c.c
The prices offered are inclusive of VAT.
Prices may change at any time. Changes do not apply to orders for which order confirmation has already been sent.
An accompanying document will be issued for each order and will certify the warranty validity. Upon the Customer’s specific request at the moment of the order, the company can issue an invoice, which will replace the accompanying document.

8. Right of Withdrawal
Under Art. D. LGS. N. 21 OF 02/21/2014, if the Customer is a consumer (a natural person purchasing the goods without job-related purposes or without specifying in the order form a VAT No. reference), he/she is entitled to exercise the right of withdrawal from the purchase contract for any reason, without giving any explanation and without any penalty, except for what is stated in the following paragraphs.
The Customer can exercise his/her right of withdrawal by sending an appropriate notice within fourteen (14) working days from date of delivery of the goods. The notice shall be sent by registered letter with acknowledgement of receipt to:

or by telegram/fax sent within 14 days and confirmed by registered letter with acknowledgement of receipt PEREMPTORILY within the following 48 hours. Once the company has received the notice of withdrawal, the Customer Service will promptly contact the customer to give him/her all the necessary instructions and assign a RMA code to return the goods. The goods must be returned to Zoffoli S.r.l. within 14 days from the return authorization. The goods must be returned undamaged, complete with all their parts and original package (envelopes and boxes), stored and (in case) used with normal diligence, without any evident sign of wear or dirt, respecting the following conditions.
The right of withdrawal is anyway subject to the following conditions:
the right shall apply only for the entire purchased product; it is not possible to return only a part of the purchased product (accessories, software, etc…);
the purchased product shall be returned undamaged and in its original package, complete with all its parts (including packaging, documentation and any other accessory: manuals, cables, etc…);
in accordance with the law (art. 57 D.Lgs. 206/2005), transport for the return of the goods shall be paid by the customer; the customer will not be refunded for delivery charges and other additional costs established at the moment of the order;
until confirmation of their receipt by the company’s warehouse, the goods are shipped under the entire responsibility of the Customer;
according to the law, the consumer is only responsible for the decrease in value of the goods resulting from a manipulation different from that necessary to establish the nature, characteristics and functioning of the goods themselves.
if the goods are damaged during transport the company shall notify the Customer thereof (within 5 working days from receipt of the goods at its warehouses) so as to permit the Customer to promptly give notice to the his/her carrier and obtain refund of the value of the goods (if insured). In this case the goods will be made available to the Customer for return and the request of withdrawal will be cancelled;
Zoffoli S.r.l. shall in no way be held liable for damages or theft/loss of goods returned by uninsured shipment;
upon arrival to the company’s warehouse, goods will be examined to assess damages or tampering not deriving from transport. If the original packaging is damaged, Zoffoli S.r.l. shall deduct a percentage from the refund (in any case max. 10% of the refund value) as compensation to cover incurred costs.
Except for the compensation to restore the damaged original packaging, Zoffoli S.r.l. shall refund the customer the entire amount paid within 14 days from return of the goods by transferring the total amount on the customer’s credit card or bank account. In case of transfer on a bank account, the customer shall provide immediately the bank coordinates to be used for restitution (IBAN code of the invoice addressee).
The right of withdrawal is entirely forfeited if the essential condition of product integrity (package and/or content) is not met, that is when Zoffoli Mappamondi S.r.l. ascertains:
improper use of the goods compromising their integrity or use of any consumable material;
lack of the original external and/or internal packaging;
lack of integral parts of the goods (accessories, cables, manuals, parts, …);
damage to the goods due to reasons other than transport.
If the right of withdrawal is forfeited, the goods will remain at the warehouses of Zoffoli S.r.l. and made available for collection at the customer’s expense.
The products sold by Zoffoli are covered by a guarantee pursuant to Legislative Decree 206/05. In case of purchase made by a subject defined as "final consumer", the warranty is valid for 24 months and covers the lack of conformity of the product. In all other cases the conventional guarantee is 12 months. In the event of receipt of defective products or in any case non-compliant with the orders placed, the CUSTOMER has the right to restore the cost of the product by repairing or replacing the product without charge.
The CUSTOMER can exercise this right if the defect occurs within two years from the delivery of the goods and reports the defect to Zoffoli within two months of discovery.
Zoffoli, in the event of a defective or non-compliant product, will arrange, at its own expense, to organize the collection of the product, compatibly with the availability of the CUSTOMER
10. Access to the site
The CUSTOMER has the right to access the site for consultation and for making purchases. No other use, in particular commercial, of the site or its content is permitted. The integrity of the elements of this site, whether sound or visual, and the relative technology used remain the property of Zoffoli.
The www.zoffoli.com website uses "cookies". Cookies are electronic files that record information related to the CUSTOMER's navigation on the site (pages consulted, date and time of consultation, etc.) and that allow Zoffoli to offer a personalized service to its customers.
Zoffoli informs the Customer of the possibility of deactivating the creation of such files by accessing their Internet configuration menu. It is understood that this will prevent the Customer from proceeding with the online purchase.
10. APPLICABLE LAW AND JURISDICTION
These General Terms and Conditions of Sale are subject to Italian law.
Any dispute that does not find a friendly solution will be subject to the exclusive jurisdiction of the Court of the CUSTOMER's place of residence or domicile, if located in the territory of the State.
